These Terms of Service apply to all purchases made through Wandering Chaos and form part of the agreement between Wandering Chaos and the customer.
By placing an order through our website, you agree to these Terms of Service.
Nothing in these Terms limits any statutory consumer rights that cannot legally be excluded under Dutch or applicable European consumer law.

2. Handmade and made to order products

Wandering Chaos creates handmade leather accessories and related products.
Products are generally produced after an order has been placed rather than being held as finished stock.
Because products are handmade, minor variations in appearance, positioning, finishing and construction may occur.
Leather is a natural material. Variations in grain, texture, markings and colour are natural characteristics of the material and are not in themselves considered defects.
These variations do not affect the customer's statutory rights where a product is genuinely defective or does not conform to the purchase agreement.

3. Product information

Wandering Chaos aims to display and describe products as accurately as reasonably possible.
Colours may appear slightly different depending on lighting, photography and the customer's screen settings.
Measurements and size charts shown on the website are intended to assist customers in choosing an appropriate size.
Where individual measurements are requested, the final product will be produced using the measurements and specifications supplied by the customer.

4. Custom made harnesses

All Wandering Chaos harnesses are individually made according to the customer's personal measurements.
After an order has been placed, Wandering Chaos will contact the customer by email to request the measurements and specifications required to produce the harness.
Standard sizes displayed on the website serve as a sizing reference. They do not replace the individual measurements requested for the production of a custom made harness.
Production begins after Wandering Chaos has received all measurements and specifications required for the order.
Because these harnesses are manufactured according to the customer's individual specifications and measurements, the statutory 14 day right of withdrawal does not apply to these products where the legal exception for personalised or custom manufactured goods applies.
This exclusion does not affect the customer's statutory rights if the product is defective, incorrectly manufactured or does not conform to the agreed specifications.

5. Customer measurements and fit

Customers are responsible for providing accurate body measurements in accordance with the measurement instructions supplied by Wandering Chaos.
Measurements must be taken carefully and supplied in the requested format.
Wandering Chaos will manufacture the product on the basis of the measurements provided by the customer.
Wandering Chaos is not responsible for fitting problems caused solely by incorrect or inaccurate measurements supplied by the customer, provided that the product has been manufactured correctly according to those measurements.
Where Wandering Chaos has made an error in the construction or sizing of the product, the customer's statutory rights remain unaffected.
Due to the handmade construction and the nature of leather accessories, small differences in fit or positioning may occur.

6. Production time

For products requiring measurements or other customer specifications, the standard production time is approximately 3 to 5 business days after Wandering Chaos has received all information required to begin production.
Shipping time is not included in the production time.
If required measurements, specifications or other information are missing, production may be delayed until the required information has been received.
If circumstances arise that significantly affect the expected production or delivery time, Wandering Chaos will inform the customer as soon as reasonably possible.
Any statutory rights relating to delayed delivery remain unaffected.

7. Chokers

Chokers ordered in a standard size can be returned within 14 days in accordance with Article 9.
Where a customer asks for a choker to be made in a custom length, or to other individual specifications, the choker is made to order for that customer and the statutory exception for custom made or personalised products may apply.
If no individual measurement is supplied, the product will be manufactured according to the selected standard sizing.

8. Nipple pasties and hygiene

Nipple pasties are intimate products and are supplied in sealed packaging for reasons of health protection and hygiene.
The statutory right of withdrawal expires once the hygiene seal has been broken after delivery.
Customers must therefore inspect the packaging before breaking the hygiene seal.
If the seal remains intact, the statutory right of withdrawal remains unaffected.
This exclusion does not affect statutory rights where the product is defective, damaged or does not conform to the purchase agreement.

9. Right of withdrawal

For products that are not excluded from the right of withdrawal, consumers have the right to withdraw from the purchase within 14 days without giving any reason. This period starts on the day the customer, or a third party designated by the customer, receives the product.
To exercise the right of withdrawal, the customer must inform Wandering Chaos of the decision to withdraw by email to info@wanderingchaos.nl before the withdrawal period has expired. The customer may use the model withdrawal form at the end of these Terms, but this is not required.
The customer must send the product back within 14 days after informing Wandering Chaos of the withdrawal.
The customer bears the direct cost of returning the product.
The original standard delivery costs will be refunded. If the customer chose a more expensive delivery method than the cheapest standard delivery offered, the additional cost will not be refunded.
Products specifically manufactured according to individual customer measurements or specifications are excluded from the right of withdrawal under applicable Dutch consumer law.
Nipple pasties with a broken hygiene seal are excluded from the right of withdrawal, as described in Article 8.
A product being handmade or produced only after ordering does not by itself mean that the statutory right of withdrawal is excluded.

10. Order changes

Customers who wish to change measurements, colour choices, hardware choices or other specifications should contact Wandering Chaos as soon as possible.
Whether a requested change can be accepted depends on the production status of the order.
If production has already started, certain changes may no longer be possible.
Where a requested change results in additional material, labour or other costs, Wandering Chaos will inform the customer of those costs before carrying out the change.
No additional charge will be made without the customer's agreement.

11. Order cancellations

Cancellation rights depend on the type of product and the production status.
For products covered by a statutory right of withdrawal, the customer's statutory rights remain unaffected.
For individually manufactured products that fall within the statutory custom made goods exception, the standard statutory right of withdrawal does not apply.
If a customer requests cancellation before production of a custom product has begun, Wandering Chaos may consider the request depending on the circumstances of the order.
Nothing in this section limits statutory rights relating to non delivery, defective goods or products that do not conform to the agreement.

12. Prices and payment

All prices displayed on the website are shown in the currency indicated at checkout.
Applicable taxes will be handled in accordance with Dutch and European tax law.
The total price payable by the customer, including any applicable shipping charges, will be displayed before the order is confirmed.
Payment must be completed using one of the payment methods offered during checkout.
Wandering Chaos reserves the right to correct clear pricing or technical errors. Where such an error materially affects an order, the customer will be contacted before the order is processed further.
Prices for future orders may change at any time. Price changes do not retroactively alter an already concluded purchase agreement.

13. Shipping

Customers are responsible for providing a complete and correct delivery address.
Before completing an order, customers should check that their name, street address, house number, postal code, city and country are correct.
If an order cannot be delivered because the customer supplied an incorrect or incomplete address, the customer should contact Wandering Chaos as soon as possible.
Additional costs resulting solely from an incorrect address supplied by the customer may be charged to the customer where legally permitted.
Shipping estimates are separate from production times and may vary depending on destination and carrier.

14. Lost or damaged shipments

Customers should contact Wandering Chaos as soon as reasonably possible if a shipment appears to be lost or arrives damaged.
For damaged shipments, customers may be asked to provide photographs of the packaging and product so that the issue can be investigated with the shipping provider.
Where Wandering Chaos is legally responsible for the delivery of the order until it reaches the consumer, that responsibility is not transferred to the customer merely because an external shipping company is used.
This does not prevent Wandering Chaos from investigating a missing or damaged parcel with the relevant shipping provider.

15. Product use and safety

Wandering Chaos products are primarily designed as leather accessories and decorative fashion items.
Certain products may also be suitable for functional use depending on their design and construction.
Customers are responsible for using products in a sensible manner and for checking that the product is appropriate for the intended use.
Products should not be subjected to loads, forces or applications for which they were not designed.
Unless a product is specifically described by Wandering Chaos as suitable for supporting body weight, suspension or another load bearing application, customers should not assume that it is designed or certified for such use.
Customers should regularly inspect leather, stitching, rivets, buckles, rings and other hardware before functional use.
If a product shows signs of excessive wear, damage or failure, use should be discontinued until the product has been assessed or repaired.
Nothing in this section excludes liability or statutory rights where these cannot legally be excluded.

16. Care of leather products

Leather is a natural material and may change over time through use, exposure to moisture, sunlight, oils and other environmental factors.
Customers should follow any care instructions supplied with the product or published by Wandering Chaos.
Improper cleaning, storage or treatment may damage the leather or hardware.
Normal wear resulting from use is not automatically considered a manufacturing defect.

17. Defective or incorrect products

Customers should contact Wandering Chaos if they believe they have received a defective, damaged or incorrectly manufactured product.
Where possible, customers should provide their order number, a description of the issue and clear photographs showing the problem.
Wandering Chaos will assess the issue and determine an appropriate solution in accordance with applicable consumer law.
Depending on the circumstances, this may include repair, adjustment, replacement or another legally appropriate remedy.
Custom made status does not remove the customer's statutory rights regarding defective or non conforming goods.

18. Returns

Before returning a product, customers should contact Wandering Chaos so that the return can be identified and processed correctly.
Products returned under the statutory right of withdrawal must be handled only to the extent necessary to establish their nature, characteristics and functioning.
The customer may be responsible for any reduction in value resulting from handling beyond what is reasonably necessary to inspect the product, where permitted under applicable law.
Custom made products and products for which a valid hygiene exception applies are subject to the exclusions described elsewhere in these Terms.

19. Refunds

Where a customer is legally entitled to a refund, Wandering Chaos will refund the customer within 14 days of the day Wandering Chaos is informed of the withdrawal.
Unless otherwise agreed, refunds will be made using the same payment method used for the original purchase.
Wandering Chaos may withhold the refund until the returned product has been received, or until the customer has provided proof that the product has been sent back, whichever is earlier.

20. Intellectual property

All original product designs, photographs, graphics, branding, website content and other creative materials produced by Wandering Chaos remain the intellectual property of Wandering Chaos or their respective rights holders.
Purchasing a product does not transfer intellectual property rights in the product design or related content.
Content from the Wandering Chaos website may not be reproduced, commercially distributed or used for commercial purposes without prior permission where such use would infringe applicable intellectual property rights.

21. Customer photographs and content

Wandering Chaos will not treat photographs or other content submitted by customers as automatically licensed for promotional use merely because they have been sent to Wandering Chaos.
Where Wandering Chaos wishes to use identifiable customer photographs, testimonials or other customer supplied content for marketing purposes, permission will be requested where required.

22. Third party services and links

The website may contain links to third party websites or use services provided by third parties, including payment providers and shipping companies.
Wandering Chaos is not responsible for the content or independent practices of third party websites.
Use of those services may also be subject to the terms and privacy policies of the relevant third party.
This does not affect Wandering Chaos's legal responsibilities toward customers under the purchase agreement.

23. Privacy

Personal data is processed in accordance with the Wandering Chaos Privacy Policy and applicable data protection law.
Measurements and other personal information supplied for custom orders will only be used for legitimate purposes connected with the order and other purposes described in the Privacy Policy.

24. Force majeure

Wandering Chaos is not responsible for delays caused by circumstances outside its reasonable control to the extent permitted by law.
Examples may include serious disruption to transport networks, natural disasters, government restrictions, major infrastructure failures or other events that could not reasonably have been prevented.
Where such circumstances materially affect an order, Wandering Chaos will communicate with the customer and seek an appropriate solution.
Statutory consumer rights remain unaffected.

25. Limitation of liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
Wandering Chaos is not responsible for damage caused solely by misuse of a product, failure to follow clear safety or care instructions, or use of a product for a purpose for which it was clearly not designed.
This clause does not limit the customer's statutory rights in relation to defective or unsafe products.

26. Changes to these terms

Wandering Chaos may update these Terms from time to time.
Changes apply to future orders from the date the updated Terms become effective.
Unless required by law or explicitly agreed with the customer, changes to these Terms do not retroactively alter the terms applicable to an order that has already been concluded.

27. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Any invalid provision will be interpreted or replaced in a manner that most closely reflects its lawful intended purpose.

28. Governing law

These Terms and purchase agreements with Wandering Chaos are governed by Dutch law, without removing any mandatory consumer protection that may apply to consumers residing in another country.
